1. Acceptance of Terms

By registering an account on ArkJuander ("the Site"), you agree to these Terms and Conditions in full. If you do not agree, do not register or use this service. These Terms are governed by the laws of the Republic of the Philippines.

2. Eligibility

You must be at least 18 years old to create an account on ArkJuander. By registering, you confirm that you meet this requirement. We reserve the right to terminate accounts found to be in violation of this policy.

3. Use of the Service

ArkJuander provides a platform for browsing, uploading, and managing song lyrics and chord charts. You agree to use the service only for lawful purposes and in a manner consistent with applicable Philippine law, including but not limited to the Intellectual Property Code of the Philippines (RA 8293) and the Cybercrime Prevention Act (RA 10175).

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at [email protected] upon discovering any unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice.

5. User-Submitted Content

By uploading chord charts, lyrics, or any other content ("User Content") to ArkJuander, you represent and warrant that:

• You own the content or have obtained all necessary rights and permissions to submit it
• Your submission does not infringe on the intellectual property rights of any third party
• You grant ArkJuander a non-exclusive, royalty-free license to display your submission on the platform

You bear full legal responsibility for any User Content you submit. ArkJuander reserves the right to remove any content at its discretion, with or without notice.

6. Copyright and Intellectual Property

ArkJuander respects intellectual property rights and complies with the Intellectual Property Code of the Philippines (RA 8293). All song lyrics and compositions displayed on the Site remain the property of their respective rights holders. ArkJuander does not claim ownership of any third-party copyrighted material.

Takedown Requests

If you are a rights holder and believe content on ArkJuander infringes your copyright, you may submit a takedown request to [email protected] with the following:

• Your full name and contact information
• A description of the copyrighted work you believe has been infringed
• The specific URL(s) of the infringing content
• A statement that you have a good faith belief the use is unauthorized
• A statement that the information in your notice is accurate, under penalty of perjury

7. Privacy and Data

We collect only the information necessary to operate your account: your name, username, and email address. We handle your personal data in accordance with the Data Privacy Act of 2012 (RA 10173) and the guidelines of the National Privacy Commission (NPC). We do not sell or share your personal information with third parties. Your password is stored in encrypted format.

Account Deletion

You may request deletion of your account and associated personal data at any time by contacting us at [email protected]. We will process your request within 30 days, subject to any legal obligations requiring us to retain certain data.

8. Prohibited Conduct

You agree not to:

• Upload or share content that infringes on the intellectual property rights of any party
• Attempt to gain unauthorized access to any part of the service or its underlying systems
• Use automated tools to scrape or extract content in bulk
• Impersonate another person or entity
• Use the service for any purpose prohibited by Philippine law

9. Disclaimers and Limitation of Liability

ArkJuander is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service. To the maximum extent permitted by Philippine law, ArkJuander and its operators shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the service. Our total liability, if any, shall not exceed the amount you paid to use the service in the 12 months preceding the claim. For free accounts, this limit is zero.

10. Modifications to These Terms

We reserve the right to update these Terms at any time. For material changes, we will notify registered users via email or in-app notice at least 14 days before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the revised Terms.

11. Dispute Resolution

If you have a dispute with ArkJuander, contact us first at [email protected]. We will make a good faith effort to resolve it informally within 30 days. If informal resolution fails, disputes shall be subject to the jurisdiction of the appropriate courts of Metro Manila, Philippines, under Philippine law.
